e-charity Rental Bicycle Terms of Use

Article 1 (General Provisions)

  • The rental terms and conditions establish the rental agreement (hereinafter referred to as "rental agreement") between the user (hereinafter referred to as "customer") and Easy Charity Co., Ltd. (hereinafter referred to as "the company" or "the store"). Customers must agree to these terms to use this service.
  • In addition to these terms, customers also accept any additional regulations or details set forth by the company regarding rental use when utilizing this service.
  • Users of this service are considered to have agreed to these terms. The company may revise these terms without prior notice, and the revised terms will apply from the time they are displayed on the service. If the service is used after the revision, it is deemed that the user has agreed to the revised terms.

Article 2 (Purpose of the Service)

The company provides this service to rent "electric assist bicycles" (hereinafter referred to as "the bicycles") to customers for a specified period and fee.

Article 3 (Ownership)

The ownership of the bicycles belongs to the company.

Article 4 (Usage Time, Rental Fees, and Extension of Rental Period)

  • Rental fees are charged daily based on the specified rate for each product.
  • The rental period begins during business hours on the day of rental (rental procedure and vehicle handover), with that day counted as the first day (0 nights, 1 day).
  • A day is counted until the end of business hours; if returned after business hours, it will be counted as the second day (1 night, 2 days).
  • The rental termination (return procedure and vehicle return) must also occur during business hours. If the bicycle is returned after business hours on the rental end date, the customer must pay the extension fee as per company regulations.
  • Changes to the rental product are not allowed once the product is ready for rental.
  • Rental fees will still apply if the bicycle cannot be used due to customer negligence, except for failures caused by the company's responsibility.
  • If the rental is extended beyond the end date, the extension fee must be paid in advance.
  • The start date for the extension period will be the same as the rental end date during the existing contract.
  • Customers must notify the store of their desire to extend by one business day before the rental end date and promptly pay the extension fee.
  • If the desired extension end date falls on a company holiday, the application must be made to ensure the rental ends on the business day before or after the holiday.
  • Extension procedures on the same day as the rental end date may not be possible depending on vehicle availability.

Article 5 (Cancellation)

  • This service can only be canceled for reasons deemed valid by the company.
  • If a cancellation request is made by 5 PM one business day before the rental start date, a refund will be issued. However, depending on the payment method, the refund may be minus transaction fees.
  • No refunds will be issued for payments made at the time of application in the case of early termination.
  • If the customer does not arrive on the rental start date without prior notice, no refunds will be issued for the payment made at the time of application.

Article 6 (Delivery of Goods)

  • The bicycles will be handed over during business hours after all necessary procedures and explanations are completed. A copy of an ID that proves the current address must be submitted at the time of handover.

Article 7 (Return of Goods)

The bicycles must be returned during business hours. Pickup and return procedures outside the store are generally not conducted.

Article 8 (Application for Rental)

All applications must be processed through the reservation site.

Article 9 (Cancellation of Application)

Applications may be canceled due to unavoidable reasons such as damage or loss of the product, or if the product is out of stock. In this case, customers will be informed in advance via email or other communication methods from the reservation site.

Article 10 (Management of Bicycles)

  • Customers must use and manage the rented bicycles with the care of a good manager.
  • Bicycles should be stored in a location protected from rain and wind, or covered with a bicycle cover. Damage to electrical components like the drive unit or switches may occur due to typhoons or heavy rain. In such cases, repair costs and related expenses will not be covered.
  • If the bicycle is returned in a condition that is excessively dirty, making it impossible to lend to the next customer immediately, a cleaning fee equivalent to one day's rental may be charged.

Article 11 (Malfunction)

  • Repairs for failures caused by wear and tear, flat tires, falls, or collisions due to customer operation will incur charges. Please contact the store or bring the bicycle to a nearby electric assist bicycle repair shop. If repairs are made elsewhere, please use genuine parts.
  • When returning the bicycle, it should be restored to its original condition at the start of the rental. If non-genuine parts, flat tires, deterioration, scratches, damage, or rust are found during the final check upon return, the customer may be charged for repair costs determined by the company.

Article 12 (Liability for Damages)

  • If the bicycles become irreparable or unreturnable due to improper use or handling by the customer, the customer must pay the actual repair costs in the case of an accident.
  • In the event of theft, a theft report must be filed, and the customer must inform the company of the police station, date of report, and receipt number. Since used rentals do not have manufacturer guarantees, the amount will be based on the sales price of an equivalent model, with 50% paid if the number of keys that came with the used bicycle can be provided, and 80% if the keys are lost and cannot be provided.
  • For lost keys, a payment of 3,000 yen (excluding tax) will be required for each key.

Article 13 (Compensation for Third-Party Damages)

If any personal or property damage occurs to a third party due to the customer's use or storage of the bicycles, the customer is responsible for promptly compensating the third party for damages equivalent to the degree of damage. The company does not handle bicycle insurance; customers must obtain their own.

Article 14 (Removal of Abandoned Bicycles)

If the bicycle is removed as an abandoned bicycle, a return notification will be sent to the company, which will contact the customer for pickup. In this case, the customer must pay the actual costs incurred plus a pickup fee of 8,000 yen (excluding tax). If the picked-up bicycle is damaged, the repair costs will be borne by the customer. The picked-up bicycle will be stored by the company, and the customer must come to retrieve it. If delivery is requested, a shipping fee of 15,000 yen (excluding tax) will apply, payable in cash upon delivery.

Article 15 (Accidents)

The company assumes no responsibility for any accidents or injuries that occur while using the bicycles.

Article 16 (Prohibited Actions)

Customers may not engage in the following activities without written consent from the company:

  • Attaching new devices, parts, or accessories to the bicycles or removing existing ones.
  • Modifying the bicycles or changing their performance or functionality.
  • Using the bicycles for purposes other than their intended use.
  • Removing the owner's labels or stickers displayed on the bicycles.
  • Allowing third parties to use the bicycles, or transferring, pledging, subletting, or otherwise disposing of them.

Article 17 (Notification)

If there are any changes to the customer's address, phone number, etc., please contact the company immediately.

Article 18 (Termination)

The company can terminate this agreement without any notice if it determines that any of the following conditions apply:

  • If the customer becomes unable to pay or suspends payment.
  • If the customer violates any term of this agreement.

Article 19 (Retrieval upon Termination)

If this agreement is terminated under Article 18, the company will immediately retrieve the bicycles. The costs incurred for this retrieval will be borne by the customer, who must cooperate sincerely with the retrieval process.

Article 20 (Refund of Rental Fees)

If this agreement is terminated under Article 18, the customer must pay the remaining balance related to the remaining rental period in a lump sum.

Article 21 (Jurisdiction)

In the event of a dispute arising from this agreement, Naha District Court or Naha Summary Court shall be the exclusive court of first instance.
